1. Acceptance of Terms
By accessing or using SahiKaam ("the Platform"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Platform.
2. Description of Service
SahiKaam is an AI-powered platform that acts as a facilitator connecting employers and job seekers. We provide job listings, resume parsing, ATS scoring, interview preparation, and related career services.
Platform Role: SahiKaam is solely a technology platform and intermediary. We are not an employer, recruitment agency, placement consultant, or labour contractor. We do not enter into any employment relationship with candidates or employers. Our role is limited to providing a digital space where employers can post opportunities and candidates can apply.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials. You must provide accurate, current, and complete information during registration. You may not share your account with others.
4. Job Seeker Responsibilities
Job seekers agree to:
- Provide truthful, accurate, and verifiable information in their profiles, resumes, and applications
- Not submit fraudulent, forged, or misleading documents or credentials
- Not attempt to manipulate the ATS scoring system or otherwise game the platform
- Independently verify the authenticity of any employer or job posting before accepting an offer
- Not demand or accept any payment, fee, or commission from employers in exchange for applying or joining
- Respect employer confidentiality and intellectual property
No Guarantee of Employment: SahiKaam does not guarantee that any candidate will receive a job offer, interview, or response from any employer. Listing or applying through the Platform does not create any right to employment.
5. Employer Responsibilities
Employers agree to:
- Post genuine job openings with accurate descriptions, salary ranges, and work locations
- Verify Candidate Authenticity: Before issuing any offer letter, appointment letter, or joining letter, employers must independently verify the authenticity of the candidate's identity, qualifications, experience, documents, and any other credentials. SahiKaam does not verify or guarantee the accuracy of candidate-provided information.
- Not discriminate against applicants based on protected characteristics
- Respond to applications in a timely manner
- Comply with all applicable employment, labour, and tax laws including but not limited to the Factories Act, 1948; Industrial Disputes Act, 1947; Minimum Wages Act, 1948; Payment of Wages Act, 1936; and all applicable state-specific regulations
- Ensure that the offered salary, benefits, and working conditions meet or exceed the minimum standards prescribed by law
- Not collect any fee, deposit, or security from candidates at any stage of the recruitment process
Sole Responsibility: Employers shall be solely responsible for all decisions related to hiring, compensation, terms of employment, background verification, and issuance of joining/appointment letters. SahiKaam shall not be liable for any disputes, claims, or liabilities arising from the employer-candidate relationship.
6. Privacy & Data Protection
We collect and process personal data as described in our Privacy Policy. By using the Platform, you consent to such processing. We implement reasonable security measures but cannot guarantee absolute security of data transmitted over the internet.
7. Cookies
We use essential cookies for authentication and session management. Analytics cookies help us improve the Platform. You may manage cookie preferences through your browser settings. Continued use of the Platform constitutes acceptance of our cookie practices.
8. Intellectual Property
All content on the Platform, including logos, text, graphics, and software, is the property of SahiKaam or its licensors. You may not reproduce, distribute, or create derivative works without prior written consent.
9. Limitation of Liability
SahiKaam is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, we expressly disclaim all liability for:
- No Responsibility for Salary or Employment Terms: SahiKaam does not determine, negotiate, guarantee, or take any responsibility for the salary, wages, compensation, benefits, working conditions, or any other terms of employment offered by employers or accepted by candidates. All such matters are the sole responsibility of the employer and candidate.
- No Verification of Listings: Accuracy, legality, or authenticity of job listings, employer profiles, or candidate profiles posted by third parties
- No Endorsement: Any reference to a particular employer, candidate, educational institution, or certification does not constitute an endorsement or recommendation by SahiKaam
- Decisions made by employers based on ATS scores, resume parsing, or any automated feature
- Loss of data, service interruptions, or technical errors beyond our reasonable control
- Indirect, incidental, special, consequential, or punitive damages arising from Platform use
- Any disputes, claims, damages, or losses arising from interactions, agreements, or employment relationships between employers and candidates
In no event shall SahiKaam's total liability exceed the amount paid by you (if any) to use the Platform in the twelve (12) months preceding the claim.
10. Disclaimer of Warranties
SahiKaam does not warrant that:
- The Platform will be uninterrupted, error-free, or secure
- Any employer or candidate is who they claim to be
- Job listings are accurate, current, or compliant with law
- Candidate profiles, resumes, or credentials are genuine or verified
- The ATS scoring, resume parsing, or AI features are error-free or suitable for any particular purpose
All platform features and content are provided on an "as is" and "as available" basis without any warranty of merchantability, fitness for a particular purpose, or non-infringement.
11. Indemnification
You agree to indemnify, defend, and hold harmless SahiKaam, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable legal fees) arising from:
- Your use of the Platform
- Your violation of these Terms & Conditions
- Your violation of any third-party rights, including but not limited to intellectual property, privacy, or employment rights
- Any false, misleading, or fraudulent information provided by you
- Any dispute between you and another user (employer or candidate) of the Platform
12. Fraud Warning & Premium Services
Free Services: Registration, job search, applying to jobs, resume upload, and basic ATS scoring are available at no cost. Premium Services: SahiKaam offers optional paid premium services to candidates, including but not limited to enhanced profile visibility, advanced ATS analysis, interview preparation tools, resume builder, and priority support. Premium plans and pricing are clearly displayed before any purchase. All payments are voluntary and for value-added features only — no payment is ever required to apply for jobs or be considered by employers.
Fraud Warning: If any person or entity fraudulently claiming to represent SahiKaam requests payment for services that are advertised as free, or demands payment via unofficial channels, please report it immediately to our contact page. Employers are strictly prohibited from collecting any fees, deposits, or security from candidates at any stage of recruitment. SahiKaam is not responsible for any financial loss incurred as a result of fraudulent job offers or misrepresentations by third parties.
13. Prohibited Conduct
Users may not:
- Use the Platform for any unlawful purpose
- Upload malicious code or attempt to breach security
- Scrape or harvest data without authorization
- Impersonate another person or entity
- Engage in spam, phishing, or fraudulent activities
14. Termination
We reserve the right to suspend or terminate accounts that violate these terms. Users may delete their accounts at any time through the dashboard settings.
15. Changes to Terms
We may update these terms at any time. Material changes will be notified via email or Platform notice. Continued use after changes constitutes acceptance.
16. Governing Law & Dispute Resolution
These terms are governed by the laws of India. Any disputes arising out of or relating to these terms or the use of the Platform shall first be attempted to be resolved through good-faith negotiations. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.
17. Severability
If any provision of these Terms & Conditions is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
18. Entire Agreement
These Terms & Conditions constitute the entire agreement between you and SahiKaam regarding your use of the Platform and supersede any prior agreements or understandings.
